A report by Human Rights Watch has revealed that Australian children’s photos were used without consent to train artificial intelligence models in a data set called LAION-5B. This data set contains billions of images paired with captions, used to teach generative AI tools. The developers of these AI models often overlook data protection laws, believing they can achieve their goals before enforcement catches up. LAION, the organization maintaining the data set, has pledged to remove the photos, but the privacy breaches remain a concern.
The misuse of personal information, including facial images, by AI developers raises questions about privacy laws in Australia. The Clearview AI case in 2021 highlighted the breach of privacy when scraping images from websites for facial recognition. The Australian Privacy Act considers publicly available information as personal information, and organizations must provide collection notices to individuals. Strong enforcement action by the privacy commissioner is necessary to address breaches of privacy laws.
Proposed amendments to the Privacy Act may include a children’s privacy code to protect vulnerable children from the misuse of their personal information. Parents are advised to be cautious about sharing photos of their children online to prevent unwanted surveillance and potential misuse in AI data sets. While individual efforts to protect children’s privacy are important, holding tech companies accountable for their practices is crucial in safeguarding personal information.
