Noyb, a digital rights group, has filed a GDPR complaint against OpenAI, claiming that ChatGPT shared false information about a public figure and refused to allow access to and deletion of data related to him. The complaint alleges that ChatGPT’s inaccuracies violate GDPR requirements for accuracy and individual access to stored information. Noyb asserts that ChatGPT’s errors, known as ‘hallucinations’, are a common issue with AI systems. The individual in question requested access and erasure of data from OpenAI, but the company declined, prompting Noyb to seek an investigation by Austria’s data protection authority. Noyb also demands that OpenAI comply with GDPR regulations and ensure accuracy in data processing. This incident follows a similar lawsuit in the US last year, where a radio host sued OpenAI over false claims made by ChatGPT. Noyb’s data protection lawyer emphasizes the importance of AI systems complying with legal requirements and not generating false information about individuals. Italy’s data protection authority previously accused OpenAI of breaching privacy regulations, leading to a temporary ban on ChatGPT in the country. Ongoing scrutiny from a European task force is also monitoring ChatGPT’s compliance with privacy laws.
